Terms of Service (effective August 26, 2019)

All fees are based upon temporary usage of images for an individual property listing.

The fees cover the purchase of a license to use the images for a specified period of time; however, Christy Hunter Photography retains the permanent Copyright and ownership of the images.

The term of usage of the images by the original purchaser is intended for a singular MLS listing. That term ends at the point the property changes ownership or the listing is removed from the MLS.

The images may be posted online or printed by the original purchaser.

The original purchaser may add text overlay or crop the images, if so desired, in order to market the property for sale.

Third parties, aside from the original purchaser, must contact Christy Hunter Photography directly for additional licensing and fees, prior to using the images. Original purchaser may not freely give images to third parties.

If the situation arises in which the original purchaser chooses to re-list the property on the MLS at a later date (after closing the original MLS listing), Christy Hunter Photography must be contacted for additional licensing fees. This also applies to ongoing MLS listings where the exact property photographed has been sold.

For Sale By Owner Listings: FSBO listings may not use Christy Hunter Photography images under any circumstance. If images were taken and licensed to an original purchaser (listing agent) and the listing was subsequently removed, that license has expired. If that property is later listed as a FSBO, the property owner may not use the images. The original purchaser no longer has an active license to the images and may not give access to the images to the property owner.

Property Owner's Rights: The property owner has no rights to the images. The original purchaser (listing agent) is the entity that acquired a license to use the images. The original purchaser may choose to give a keepsake print, memory book, etc., to the property owner containing the images as a thank you gift. If a property owner wants to promote the listing on social media, this can only be done by sharing the listing information from the original purchaser’s (listing agent’s) social media site or from the original listing. The property owner (or any third party) may not save the electronic images from the listing, or the original purchaser’s social media site, and create a unique social media post.
